# Voluntary payment, defence and limitation: the deadlines of a traffic fine in Argentina

A fine has three clocks: the discount, the defence and the limitation period. This guide explains what runs on each, who sets it and how to look up in time to decide with all the data.

A traffic fine in Argentina is not a fixed amount but one that changes over time: it costs less if paid right away, can be disputed only within a period and stops being enforceable once it prescribes. For a fleet, managing those three clocks is worth more than disputing every fine. This guide describes how they work under the [National Traffic Law 24.449](https://www.argentina.gob.ar/normativa/nacional/ley-24449-818/texto) and the provincial adhesions, and why the date of the lookup matters as much as the date of the infraction.

## Voluntary payment

The law and the local rules provide for voluntary payment: whoever accepts the fine and pays it before the court rules gets a reduction of the amount, and the procedure ends there, with no further record. The reduction and the period are set by each jurisdiction in its adhesion rule, and official sources usually show the discounted amount and the date until which it applies. The point for a company is that this period runs from the notice, not from the moment someone in the company found out.

## The defence

Whoever does not accept the fine files a defence with the authority that issued it, in writing or through the court’s digital channel, within the period set by the notice. The defence needs grounds: the trip log showing the unit was elsewhere, proof that the driver was someone else, the documentation that was missing. Once a defence is filed, the discounted amount is no longer available in most jurisdictions, so the decision between paying and disputing is best taken with the fine in view and within the period.

## Limitation

[Law 24.449](https://www.argentina.gob.ar/normativa/nacional/ley-24449-818/texto) sets different limitation periods for minor and serious offences, counted from the date of the infraction and interrupted by procedural acts, and each adhering province may have its own rules. Limitation does not erase the fine from the sources by itself: it must be requested before the court. In practice, a very old fine that appears in a lookup deserves a review before it is paid.

The concrete periods, in days or years, are set by each jurisdiction; the official source of each fine and the notice are the documents that count. This guide describes the mechanics and does not replace reading the applicable rule.

## The three clocks in a fleet

- Discount clock: the monthly and per-event lookup finds the fine with margin to pay with a reduction.
- Defence clock: the trip log stored next to the result allows a defence with grounds.
- Limitation clock: old fines are set aside for review before any payment.

## How the API lookup solves it

The [Argentina traffic fines API](https://apinitro.com/en/apis/traffic-fines-argentina/) returns each fine with the event date, the amount and the status as the source publishes them, and splits the result by authority. With that result stored, a fleet sorts the fines by the clock that applies: those within the voluntary-payment period go to payment or driver assignment, the disputable ones go to a defence with the record that justifies them and the old ones go to review. The guide on [integrating fine lookups into a fleet](https://apinitro.com/en/articles/integrating-fine-lookups-into-a-fleet-operation/) explains when to look up so that no clock reaches zero without a decision.

## Limits

- The API does not pay, file defences or request limitation; it delivers the information to decide in time.
- A source that does not answer is reported as such, never as an absence of fines.
- The final amount is set by the authority at the time of payment, with the applicable discount or surcharge.
